Some of you might remember that Professor Paolo Palchetti, University of Macerata, visited DILS back in March 2016. Professor Palchetti spoke about cases brought by the Marshall Islands against major nuclear states for not fulfilling their obligations with respect to nuclear non-proliferation. On 5 October 2016, the International Court of Justice rendered judgment in three cases brought against India, Pakistan and the UK.
The Court found, with the narrowest possible majority, that no dispute existed. This means that the Court does not have jurisdiction to hear the merit of the cases. Since then, the blogosphere has exploded. For comments, see here, here, here and here.
